Other terms used in these general terms of sale are understood as follows:
'Buyer': Any natural person (B2C) who has or will have any contractual relationship with Place Reservee. Each 'Buyer' agrees not to purchase the products on Place Reservee solely for the purpose of reselling them. Hereinafter also referred to as 'you', 'your'.

'Consumer': Any natural person acting as a Buyer for purposes outside their business or professional activity.

'Products': All goods and services that are the subject of this sales agreement. 'Goods manufactured according to the specifications of the Consumer': Goods that are not prefabricated and that are manufactured based on an individual choice or decision of the Consumer.

'Sales Agreement': Any agreement whereby the trader undertakes to transfer ownership of goods and/or provide a service to the Buyer. This Buyer in turn agrees to pay the price thereof.

These General Terms and Conditions of Sale apply at all times and exclusively to all current and future Sales Agreements between Place Reservee and the Buyer. The Buyer accepts the applicability of these General Terms and Conditions of Sale, as

How is the agreement concluded?

Place Reservee takes the utmost care when placing information online about the characteristics of its products, including technical descriptions based on data provided by its partners and suppliers, and photographs illustrating the products, as far as technical means allow. Certain non-substantial characteristics of a product may differ from the photographs and descriptions displayed on the website at the time of delivery.

Any offer on our website is merely an invitation to the Buyer to make a purchase and therefore cannot be considered a binding offer from Place Reservee to the Buyer. Furthermore, the offer is only valid while stocks last. We reserve the right to apply specific conditions to a particular offer, such as a limited validity period. Such specific conditions only apply if they are explicitly communicated prior to the order.

If the Buyer wishes to purchase a product from the Place Reservee range, they must place an order using the online ordering methods. This purchase is binding for the Buyer. Place Reservee will contact the Buyer within 7 calendar days after the order to confirm it. This confirmation will be sent by email to the email address provided by the Buyer. This order confirmation marks the moment when the agreement is established.

Place Reservee may decide at any time not to send a confirmation or to refuse the product order in an explicit statement. If the order cannot be fulfilled or can only be partially fulfilled, Place Reservee will inform the Buyer and, if necessary, propose a substitute product. If Place Reservee refuses the product order or the Buyer does not agree to the proposed alternatives, no agreement will be established. The Buyer has no right to any form of compensation.

In accordance with the Economic Code, the parties expressly acknowledge that electronic communication means constitute a valid agreement. Place Reservee may use all electronic files at its disposal, within the limits of the law, to prove the agreement. A standard, digital or electronically qualified signature is not an essential requirement for proof.

Our prices

All prices are expressed in euros and include VAT and other taxes. Delivery costs and other additional charges (see payment methods) are not included in the individual product price. Such costs are always explicitly stated in the final step of our online ordering process.

The Buyer owes the amount that Place Reservee has communicated to them in its confirmation in accordance with Article 2 of these General Terms and Conditions. Clear or evident errors in the price quotation, such as obvious inaccuracies, may also be corrected by Place Reservee after the agreement has been concluded. Complaints regarding the price (determination) must be communicated clearly and in writing within seven (7) calendar days. Submitting a complaint does not lead to the suspension of payment.

Place Reservee reserves the right to change prices at any time, but we commit to applying the rates indicated on the site at the time of your order. If the price change is due to changes in VAT rates, this will be passed on to the Buyer.

Payment Terms

In principle, each payment is processed immediately and in full at the moment the order is placed by the Buyer. We accept the following payment methods:

Mastercard / VISA / Bancontact / Ideal / PayPal / Apple Pay

Vouchers are only accepted within our sales areas and not for distance contracts. Place Reservee may expand the payment options in the future. Any expansion of the payment options will be announced on the website. Place Reservee takes all reasonable measures to ensure the security of your online transactions. We guarantee this security by engaging specialized parties, such as recognized credit card issuers and payment partners.

The secure system of Multisafepay is responsible for the further processing of the payment and ensures that your bank details are handled in an encrypted manner. The necessary security measures via SSL are provided. Place Reservee suspends its delivery obligations until full payment of all amounts due by the Buyer has been received. Place Reservee retains ownership of all ordered products until full payment of all amounts due under this agreement has been received, regardless of whether delivery has already taken place.

How are my products delivered?

We process every order quickly. Unless a different delivery time has been agreed upon, the maximum delivery time is thirty (30) days after receipt of the order. If Place Reservee does not deliver the goods at the agreed time with the Consumer or within thirty (30) days, the Buyer may request delivery within an additional period that is appropriate given the circumstances. If Place Reservee does not deliver within the additional period, the Buyer has the right to terminate the agreement. In the event of termination, Place Reservee will refund all amounts paid promptly and no later than fourteen (14) days after termination of the agreement. Exceeding the delivery time does not entitle the Buyer to any other compensation.

When you order a product that is temporarily out of stock, you will receive a notification when the product is available again. The delivery time then starts from the moment the products are back in stock. Place Reservee uses reliable external parties for delivery, particularly BPost. The use of external parties may affect delivery. However, Place Reservee accepts no responsibility for late deliveries or for orders that have been lost due to third parties or due to unforeseen circumstances or force majeure. In the case of a non-delivered order, an investigation will be initiated with the carrier immediately. This takes a few days, during which time no refund or replacement shipment can be made.

It is the responsibility of the buyer to facilitate delivery at the agreed location in the presence of the buyer or a third party designated by the buyer. Delivery is deemed to have taken place once the ordered products have been offered to the customer. If a delivery attempt is unsuccessful due to a shortcoming on the part of the buyer or the third party designated by the buyer, the costs of new delivery attempts will be fully borne by the buyer.

Place Reservee bears the risk of damage and/or loss of the products until the moment of delivery. The risk of the products is transferred to the buyer as soon as the buyer or a third party designated by the buyer takes receipt of the ordered products. In principle, each delivery requires the signing of the delivery confirmation, but failure to sign does not affect the transfer of risk.

Default and complaints

The statutory warranty obligation, as laid down in Articles 1641 to 1649 of the Civil Code, fully applies to these General Terms and Conditions. Consequently, every Buyer is entitled to a remedy if they discover a defect in the delivery of the sold item, in accordance with the conditions of the statutory warranty obligation. Furthermore, there is a statutory warranty period of two (2) years for the Consumer. The Buyer cannot invoke their warranty rights if they were aware of the defects at the time of purchase. Additional commercial warranties are always possible in accordance with the relevant conditions.

As soon as the Buyer or a third party designated by the Buyer receives the products, this recipient is obliged to examine the products carefully. If the product or delivery is affected by a visible defect, and this is apparent to the recipient, they may submit a complaint. The Buyer must communicate these complaints explicitly, unambiguously, and with justification in writing to Place Reservee within seven (7) days of delivery to the Buyer or a third party designated by the Buyer. It is the Buyer's obligation to provide sufficient justification for this communication.

Defective products must be returned to Place Reservee, always in their original condition, including packaging, accessories, and documentation, and always accompanied by the original invoice or a valid proof of payment. Any non-compliance with this obligation will result in a proportional reduction of the refund. Returns are always at the expense and risk of the Buyer. The costs of return shipping are the responsibility of the Buyer. Place Reservee recommends returning these products by registered post with insurance to avoid the risks of loss and theft. Returns must be made within seven (7) calendar days of notification.

The warranty does not apply to: Damage caused by normal wear and tear, accidental or intentional alterations by the Buyer to the goods, including improper and incorrect use and exposure to moisture, fire, earthquake, and other external causes.

Damage caused by installation and use in a manner that is not in accordance with the given instructions and information.

In the absence of a justified complaint, the Buyer has no right to return the goods. If the above conditions are met, the Buyer is first entitled to a free repair or replacement, depending on the situation. Only when the repair or replacement is excessive or impossible, or cannot be carried out within a reasonable time, does the Buyer have the right to a full or partial refund. The Buyer must substantiate this in a clear and well-founded manner. The resulting compensation can never exceed the amount that has been invoiced to the Buyer.

If the products have been wrongly returned because the above conditions have not been met, Place Reservee will resend them to the Buyer. The costs of this return shipment are the responsibility of the Buyer. In that case, Place Reservee is free to store the products with third parties at the expense and risk of the Buyer until these return shipping costs have been paid.

Right of Withdrawal

Applicability of the Right of Withdrawal

The Consumer has the right of withdrawal, in accordance with Article VI.47 of the Belgian Code of Economic Law. The right of withdrawal gives the Consumer the opportunity to terminate the agreement if they are not satisfied with the product within thirty (30) days of delivery. No motivation or penalty is required. Place Reservee welcomes your feedback to improve our services. If the Consumer exercises their right of withdrawal in accordance with the legal conditions, Place Reservee will ensure the refund of the actual amount paid for the product within fourteen (14) calendar days. The refund will be made using the same payment method that you used for the original transaction, unless the Consumer has expressly agreed otherwise. No fees will be charged for the refund. Please note: Place Reservee does not reimburse additional shipping costs, such as the costs incurred if the Consumer chooses a shipping method that differs from the cheapest standard shipping method. According to Article VI.53 of the Belgian Code of Economic Law, the Consumer does not have the right to exercise their right of withdrawal in the following cases: Service agreements after the service has been fully performed, if the performance has begun with the prior express consent of the Consumer, and with the acknowledgment that they lose their right of withdrawal once the agreement has been fully performed by the trader (Article VI.53.1° WER); The delivery of goods made according to the specifications of the Consumer, or that are clearly personalised (Article VI.53.3°); The delivery of sealed goods that are not suitable for return for health or hygiene reasons and that have been opened after delivery (Article VI.53.5° WER); Where the delivered goods, by their nature, are inseparably mixed with other items after delivery (Article VI.53.6°).

Exercise of the right of withdrawal

The Consumer wishing to exercise the right of withdrawal must explicitly and unambiguously communicate their decision in a written statement. The communication must take place within thirty (30) calendar days from the day of obtaining physical possession of the goods. It is up to the Consumer to prove that they can invoke their right. The following information must always be clearly communicated: The following three dates: the order date, date of receipt, and the date on which the right of withdrawal is invoked; Name and address of the Consumer; Signature of the Consumer. The Consumer must return the products to Place Reservee as soon as they have communicated their decision to exercise their right of withdrawal, and no later than fourteen (14) calendar days after the communication. The return can only take place via a recognised carrier. In any case, the Consumer bears all costs and risks of the return. Place Reservee may suspend the refund until proof has been received from the Buyer that the products have been returned. The Buyer is liable for any depreciation of the products resulting from handling the products beyond what is necessary to establish the nature, characteristics, and functioning of the products. Place Reservee has the right to charge the costs of depreciation in proportion to the refund. The Consumer has no right of withdrawal if the above conditions have not been met. In that case, the goods will be returned to the Consumer at the Consumer's expense and risk. Place Reservee commits to clearly communicate its reasons to the Consumer.
